AGREEMENT: These additional terms and conditions apply to all photography services provided by Josh Gaskell Photography when booked via an agency or intermediary. For the avoidance of doubt, "The Client" refers to the end-user; this is the customer or client of the agency or intermediary.
1a. CREATIVE LICENCE: Josh Gaskell Photography shall be granted creative and artistic licence regarding the choice of locations, poses, and positions used. The Client agrees that Josh Gaskell Photography will use professional judgement regarding photographic and videographic style, as well as the number of images and videos captured.
While Josh Gaskell Photography will make every reasonable effort to honour specific requests, fulfillment is subject to weather conditions, time constraints, and the willingness of subjects. Josh Gaskell Photography does not guarantee any specific shot, background, or group arrangement.
The Client acknowledges familiarity with Josh Gaskell Photography’s portfolio and requests these services with full knowledge of and consent to the artistic style. The Client accepts that the work is unique, artistic, and evolving, and that the final images may differ from past work. Josh Gaskell Photography shall use personal artistic judgement to create images consistent with their professional vision.
1b. EDITING: Josh Gaskell Photography will provide a pleasing colour balance and enhance the images as explained in 1a, but cannot guarantee exact colour matching to human eye colour perception. Owing to anomalous reflectance caused by a combination of certain dyes and materials, especially man-made fibres, it is sometimes impossible to record on digital media/film the exact colour of materials as seen by the human eye. Josh Gaskell Photography may use editing tools or processes enhanced or supported by artificial intelligence (AI).
1c. ADDITIONAL EDITING: Any additional editing and/or retouching requested by The Client outside of the editing terms detailed in 1b will be subject to an hourly rate of £35 per hour. Retouching includes but is not limited to additional skin softening/smoothing, correction of hair/makeup/clothing, removal of objects from a scene, swapping a face from one image to another, environmental effects, teeth whitening and brightening of eyes.
2. COOPERATION: The parties agree to positive cooperation and communication for the best possible result within the definition of this assignment. Josh Gaskell Photography is not responsible for key individuals’ failure to be present or to cooperate during photography sessions, nor for missed images due to details not revealed to Josh Gaskell Photography.
3. COPYRIGHT LAW & LICENSE: The copyright of photographs remains with Josh Gaskell Photography. Subject to full payment being received, Josh Gaskell Photography grants The Client permission to make copies and prints of the images for under the following conditions:
i. The Client must obtain prior written permission from, and negotiate additional compensation for Josh Gaskell Photography before using, publishing, or selling the photographs for commercial profit.
ii. The Client shall not use Artificial Intelligence (AI) tools to alter, manipulate, or create derivative works from the original source photographs.
iii. The Client shall not use the photographs or videos to train Artificial Intelligence (AI) models or algorithms.
No licence or usage permission is granted until all agency and photographer fees are paid in full.
4. MODEL RELEASE: The Client hereby grants Josh Gaskell Photography the irrevocable, royalty-free, and unrestricted right to use, reproduce and publish photographs and video taken at the photoshoot for promotional, portfolio, advertising, editorial, or trade purposes. This right extends to all media formats, including but not limited to websites, social media, print and digital portfolios.
The grant applies to all images captured during the photoshoot, including photographs of; The Client and The Client’s attendees and guests; The photoshoot venue, setup, styling, and decor; Products, branding, and materials displayed at the photoshoot; The Client’s employees or representatives. The Client is solely responsible for notifying all attendees, guests, subcontractors, and venue staff that photography will occur and that any individual not wishing to be photographed must alert Josh Gaskell Photography prior to the photoshoot via email to: joshgaskellphotography@gmail.com or verbally to Josh Gaskell Photography at the earliest reasonable time. The Client will provide a notice of photography via ticket/invitation language, explicit photoshoot signage, or verbal announcement before the photoshoot begins.
If any attendee, subcontractor, or venue owner/staff, who did not provide objection to be photographed, later objects to the publication of their image, The Client agrees to defend and hold Josh Gaskell Photography harmless against any privacy, publicity, or copyright claims arising from such use.
5. ADVERSE CONDITIONS: The Client permits Josh Gaskell Photography to exercise professional judgement to cease or suspend work if adverse conditions arise that could damage equipment or compromise safety. Adverse conditions include, but are not limited to: laser lighting or other high intensity lighting that may damage camera sensors; wet, stormy, or otherwise unsafe weather that may damage photographic equipment; hostile or inappropriate behaviour from the client, the client’s guests, or other persons at the photoshoot location.
6. COMPLETION SCHEDULE: Photo processing takes approximately 7 days. Video processing takes approximately 7 days. When Josh Gaskell Photography is finished processing the client’s photos and videos, they will be uploaded to an online folder or album and a link will be supplied.
